    How Easy are Uncontested Divorces?

    Being said, uncontested divorce is only possible when the couple agrees on all important issues including child custody, child support, and spousal maintenance. This is because in an uncontested divorce no one is fighting and so there are no court hearings. 

    Another thing that makes uncontested divorces quick is that the couple agrees on everything, including what should happen to the house and bank accounts. You can never imagine how much time it will take if there is no agreement and you have to go to court. 

    Some of the common issues that couples end up disagreeing on are child custody and child support, marital assets and debts, alimony (spousal maintenance), who pays whom, etc. There are also cases where one partner wants the divorce while another one doesn’t—but these cases are few. That is why contested divorce is a little different because of the disagreements between couples.

    How is Contested Divorce Different from an Uncontested One?

    A contested divorce is when even basic issues, such as who gets the kids or how much spousal maintenance one partner should pay, cannot be settled. When a couple cannot agree on issues such as child support, alimony, or spousal maintenance, they cannot file for an uncontested divorce without first trying to resolve their differences.

    The process of uncontested divorce is also different because of all the disagreements. There will likely be a court hearing where both spouses have to go so a judge can make decisions regarding child support and spousal maintenance, etc.

    When you’re thinking of getting a divorce, make sure you are not just limiting your search to uncontested divorces. There are a lot of options. However, if you’re looking for a stress-free and fast divorce, then it might be wise to come to an agreement with your partner on matters such as child custody and property division and choose uncontested divorce over contested ones.

    It might not be possible for everyone to come to an agreement on each issue, but when the couple does, then the divorce process will be much more enjoyable and less expensive.
